TERMS AND CONDITIONS OF XENDA

By accessing, browsing, and using the Xenda website available at www.xendamexico.com (the “Site”), as well as by booking or purchasing any of our products or services, you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree, you must refrain from using the Site.
I. Identification
Xenda is a commercial brand dedicated to the promotion, design, and commercialization of tourism experiences in Mexico. For legal purposes, it may operate as an intermediary between travelers and independent tour operators, or as the direct organizer of certain experiences.
II. Nature of the Service
Third-party tours:
Xenda acts exclusively as a digital intermediary between the Client and independent tour operators. The execution of the service is the sole responsibility of the corresponding operator.
Xenda-operated tours:
When an experience is organized directly by Xenda, it assumes responsibility for service delivery as offered, except in cases of force majeure.
III. Legal Capacity
The Client declares that they are of legal age and have sufficient legal capacity to enter into a contract. In the case of minors, they must be accompanied by a responsible adult.
IV. Bookings and Payments

Bookings are made through the Site.

A deposit or full payment may be required.

Payments are processed through secure platforms.

A booking is confirmed only when the Client receives official confirmation via email.

Xenda reserves the right to cancel bookings due to manifest errors in pricing, availability, or technical failures.
V. Cancellation and Refund Policy

For third-party tours, the operator’s policies will apply.

For Xenda-operated tours, the specific policy provided at the time of purchase will apply.

Refunds, when applicable, will be issued through the original payment method.

No refunds will be granted for no-shows or late arrivals by the Client.
VI. Risks and Liability
The Client acknowledges that tourism activities may involve inherent risks (weather conditions, physical activities, transportation, etc.).
Xenda shall not be liable for:

Accidents attributable to independent operators

Loss of personal belongings

Events arising from force majeure (weather conditions, protests, government actions, etc.)
For Xenda-operated tours, liability shall be limited to the amount actually paid for the service.
VII. Client Conduct
The Client must:

Comply with schedules

Follow safety instructions

Maintain respectful behavior

Refrain from unlawful conduct
Xenda reserves the right to deny service without refund in cases of inappropriate behavior.
VIII. Personal Data
Personal data is processed in accordance with the Privacy Notice available on the Site, in compliance with the Federal Law on Protection of Personal Data Held by Private Parties.
IX. Image Use
During experiences organized directly by Xenda, photographs or videos may be taken. Any promotional use will require the Client’s explicit consent.
X. Intellectual Property
All content on the Site is the property of Xenda or its rightful owners. Reproduction without prior authorization is strictly prohibited.
XI. Indemnification
The Client agrees to indemnify and hold Xenda harmless from any claims arising from their conduct, breach of these Terms, or improper use of the Site.
XII. Modifications
Xenda may modify these Terms at any time. Changes will take effect upon publication.
XIII. Jurisdiction and Governing Law
These Terms are governed by the applicable laws of the United Mexican States. Any dispute shall be submitted to the competent courts of Mexico City.
